Please review these Terms of Service ("Terms") thoroughly before engaging with our platform. This document constitutes a legally binding contract between you ("User" or "you") and Pick Up My Appliance ("we," "us," or "Pick Up My Appliance") governing your access to and use of our website and related features (collectively, the "Service"). By using or accessing the Service, you signify your agreement to be legally bound by these Terms.

1. Acceptance of the Agreement

By navigating or using the Pick Up My Appliance platform and its associated services, you affirm that you understand, accept, and consent to comply with these Terms. If you object to any portion of these Terms, you are prohibited from utilizing the Service. By engaging with the platform, you certify that you are at least 18 years of age.

2. Overview of the Service

Pick Up My Appliance provides a digital marketplace designed to connect property owners looking to discard appliances at no cost ("Users") with independent local businesses and service providers ("Partners") capable of removing them. Please note that Pick Up My Appliance acts solely as an intermediary coordinator. We do not perform removals ourselves, nor do we assume responsibility or liability for the actions, quality, or conduct of our Partners.

3. Registration and Submissions

Accessing specific functionalities of the platform requires the submission of data via our online webforms.

For Users (Appliance Owners): When submitting an appliance removal request, you promise to supply truthful, current, and precise details. You acknowledge and authorize that your contact details and appliance descriptions will be shared with our network of Partners to coordinate the physical pickup.

For Partners (Removal Contractors): When registering as an authorized Partner, you agree to maintain accurate business profiles and contact information. You are solely accountable for securing your login credentials and for all actions taken under your account. You pledge to maintain professional and ethical business standards when communicating with leads obtained through our platform.

3.1 Content Licensing

If you upload images or other media through the Service, you grant Pick Up My Appliance and its designated Partners a royalty-free, worldwide, non-exclusive license to host, replicate, and display that content exclusively to facilitate your removal request. This media license automatically expires when the content is purged from our servers, which occurs within 30 days of submission.

You guarantee that you possess full ownership or legal authorization to distribute all uploaded media, and that such content does not infringe upon the intellectual property or privacy rights of any third party.

4. Financial Terms and Premium Access (For Partners)

Partners may access un-redacted lead information through either an individual lead acquisition model or an ongoing subscription tier.

Pay-Per-Lead: Partners may pay an individual fee to unlock the full contact information of a single request. Credit card processing and billing are managed securely by our third-party merchant provider, Stripe.

Monthly Subscriptions: Partners can purchase a recurring monthly subscription for unrestricted access to un-redacted consumer inquiries within specified territories. These subscriptions automatically renew at the end of each billing cycle unless cancelled prior to the renewal date.

4.1 Lead Allocation and Territorial Rights

For Pay-Per-Lead Partners: Lead alerts may be broadcast to multiple non-subscribed partners concurrently. These opportunities are sold on a first-come, first-served basis. The first partner to successfully complete the checkout process gains exclusive access to the client's full details, removing the lead from the market. Should another partner purchase the lead while your transaction is processing, the system will void the sale, and you will receive a full refund within 5 business days.

For Subscription Partners: Maintaining a valid, paid monthly subscription for a specific municipality grants you total exclusivity over all inbound requests originating from that city during the active term. No other partners—whether pay-per-lead or subscription-based—will see or receive notifications for leads in your protected territory. This exclusivity terminates immediately if your subscription lapses, fails to renew, or is cancelled.

All successfully processed transactions are final. Our full criteria for charge reversals are detailed in our separate Refund Policy, which is explicitly integrated into these Terms.

5. Prohibited Conduct

When utilizing the Service, both Users and Partners agree to refrain from:

  • Submitting fraudulent, deceptive, or intentionally incorrect details.
  • Conducting any activities that violate local, state, or federal laws.
  • Attempting to breach, bypass, or compromise our digital infrastructure or the accounts of other members.
  • Utilizing our platform for any commercial purpose outside of its intended lead-matching design.
  • Disrupting the operational performance or stability of our digital systems.
  • Violating the copyrights, trademarks, or proprietary rights of Pick Up My Appliance or third parties.

We reserve the right to temporarily freeze or permanently delete accounts that violate these behavioral standards.

6. Proprietary Rights

All materials, designs, branding, logos, text, code, and interfaces featured on this Service are the sole property of Pick Up My Appliance or its authorized content suppliers. These materials are protected under international copyright, trademark, and intellectual property statutes. Your interaction with the platform grants you no implicit rights or licenses to use our brand assets without explicit, prior written authorization from us.

7. Warranty Disclaimers and Liability Restrictions

THE SERVICE IS PROVIDED EXCLUSIVELY ON AN "AS IS" AND "AS AVAILABLE" FOOTING. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPLICIT, IMPLIER, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, AND FITNESS FOR A PARTICULAR PURPOSE.

Pick Up My Appliance makes no guarantees regarding the reliability, timeliness, or safety of the services rendered by its Partners. All operational disputes arising from a pickup are strictly between the User and the Partner.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Pick Up My Appliance WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES, NOR FOR ANY LOSS OF REVENUE, DATA, USER TRANSACTIONS, OR REPUTATIONAL HARM. THIS INCLUDES CLAIMS TIED TO: (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) THE ACTIONS OR STATEMENTS OF ANY THIRD PARTY, USER, OR PARTNER ON THE SERVICE; OR (C) SYSTEM VULNERABILITIES OR ALTERATIONS TO YOUR DATA.

UNDER NO CIRCUMSTANCES SHALL THE MAXIMUM TOTAL LIABILITY OF Pick Up My Appliance EXCEED THE GREATER OF: (A) THE AGGREGATE FEES YOU PAID TO US DURING THE SIX (6) MONTH PERIOD PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

8. Governing Law and Arbitration Agreement

These Terms shall be interpreted, governed, and enforced under the internal laws of the State of Utah, without regard to conflict of law rules.

Any legal conflict, dispute, or claim arising out of this contract or your use of the platform shall be settled definitively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration proceedings shall be held exclusively in Salt Lake City, Utah.

By agreeing to these Terms, you voluntarily waive your right to a trial by jury and agree that all disputes must be resolved individually; you expressly waive any right to initiate or join class-action litigation or class-wide arbitration.

9. Account Cancellation and Termination

We reserve the right to suspend or terminate your access to the Service at any moment, without notice or liability, for any justifiable reason, including if you violate these foundational Terms. Upon termination, your right to use the system ceases instantly. Partners looking to close their accounts may do so by cancelling their subscriptions via their dashboard or contacting support.

10. Modifications to the Terms

We maintain the right to revise or update these Terms at our sole discretion. For significant revisions, we will attempt to post a notification at least 30 days before the new provisions go into effect. We retain the sole authority to determine what constitutes a material update. By continuing to use the platform after modifications take effect, you consent to be bound by the updated contract.
